Disclaimer & Safe Harbour Statement

This Disclaimer (“Statement”) governs your use of the Freedom Protocol community platform (“Platform”) and clarifies the distinction between the community hub and the Freedom Protocol Care App (“Care App”). Both are operated by Freedom Protocol Ghana Limited Company, a limited liability company incorporated in the Republic of Ghana. By accessing or using the Platform you acknowledge that you have read, understood, and agree to be bound by this Statement in its entirety.

Freedom Protocol is a proprietary health platform developed and operated by Freedom Protocol Ghana Limited Company.

1. Community Content Disclaimer

The community hub — including articles, discussion posts, community resources, event presentations, and peer-shared content — is for general educational and informational purposes only. Community content is not intended and must not be construed as:

  • Professional medical advice, diagnosis, or treatment
  • A substitute for consultation with a qualified, licensed healthcare provider
  • An endorsement of any specific treatment, therapy, medication, or course of action

For personalised medical advice, Freedom Protocol offers the Care App, a separate clinical service where you can consult directly with licensed, verified doctors. Community content should complement — never replace — the professional guidance you receive through the Care App or your personal healthcare providers.

2. Care App & Clinical Services

The Freedom Protocol Care App is a separate clinical platform that connects patients with licensed healthcare professionals for telemedicine consultations, health tracking, and personalised medical advice. Key distinctions:

  • The Care App does facilitate access to professional medical advice through licensed doctors
  • Doctors on the Care App are independent practitioners — each is individually responsible for their own clinical decisions, professional conduct, and malpractice coverage
  • Freedom Protocol facilitates the connection between patients and doctors but does not direct, supervise, or control the clinical judgment of any practitioner
  • The doctor-patient relationship formed through the Care App is governed by the practitioner's own professional terms and the laws of the Republic of Ghana

Emergency Notice: If you think you may have a medical emergency, call your doctor, go to the nearest hospital emergency department, or call emergency services (e.g. Ghana National Ambulance Service — 193) immediately. The Care App is not a substitute for emergency medical services.

3. No Doctor-Patient Relationship via Community Hub

Use of the community hub — including participation in discussions, attendance at events, or browsing professional profiles — does not create a doctor-patient, therapist-client, or any other professional-client relationship between you and Freedom Protocol, Freedom Protocol Ghana Limited Company, or any listed health professional.

A doctor-patient relationship is only established when you engage a practitioner through the Care App or through their independent clinical practice. Any such engagement is governed by their own professional terms, licensing obligations, and applicable law.

4. Professional Verification Disclaimer

Freedom Protocol verifies that listed health professionals hold valid credentials and registration numbers with the relevant Ghanaian regulatory bodies (e.g. Medical and Dental Council of Ghana, Pharmacy Council, Allied Health Professions Council) at the time of their application. This verification:

  • Confirms credential authenticity only — it does not constitute an endorsement, recommendation, or guarantee of clinical competence, quality of care, or patient outcomes
  • Is conducted at the point of onboarding and may not reflect subsequent changes in a professional's licensure status
  • Does not make Freedom Protocol or Freedom Protocol Ghana Limited Company vicariously liable for any act, omission, negligence, or malpractice by any listed professional, whether on the community hub or the Care App

You are solely responsible for conducting your own due diligence before engaging any health professional for clinical services.

5. User-Generated Content — Safe Harbour

The community hub hosts user-generated content (“UGC”) including discussion posts, replies, community resource submissions, and event chat messages. In accordance with the principles of intermediary liability and the safe harbour doctrine:

  • Freedom Protocol acts as a neutral intermediary and is not the author, editor, or publisher of UGC
  • We do not guarantee the accuracy, completeness, reliability, or medical soundness of any UGC
  • Views expressed in UGC are those of the individual author and do not represent the views of Freedom Protocol or Freedom Protocol Ghana Limited Company
  • UGC is not a substitute for medical advice — for clinical guidance, use the Care App
  • We reserve the right — but are not obligated — to monitor, moderate, remove, or disable access to any UGC that violates our Terms of Service or applicable law
  • Reliance on any UGC is strictly at your own risk

If you believe any UGC infringes upon your rights, contains unlawful content, or constitutes dangerous health misinformation, please report it to legal@freedomprotocol.health and we will act promptly upon notice.

6. Third-Party Links, Products & Services

The Platform may contain links to third-party websites, applications, or services, including but not limited to the Freedom Protocol Care App, e-commerce storefront, and external health resources. These links are provided for convenience only. Freedom Protocol:

  • Does not control, endorse, or assume responsibility for the content, privacy practices, or availability of any third-party service
  • Is not liable for any loss or damage arising from your use of or reliance on any third-party product, service, or content
  • Does not warrant the suitability, safety, or efficacy of any product sold through our e-commerce channels for any specific medical condition — always consult your physician or a doctor via the Care App before making dietary or medical supply changes

7. Limitation of Liability

To the fullest extent permitted by the laws of the Republic of Ghana:

  • The Platform and Care App are provided on an “as-is” and “as-available” basis without warranties of any kind, whether express, implied, or statutory
  • Freedom Protocol, Freedom Protocol Ghana Limited Company, its directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your access to or use of — or inability to access or use — the Platform or Care App
  • Freedom Protocol is not liable for any clinical decisions, advice, or treatment provided by independent practitioners accessed through the Care App
  • This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages

8. Indemnification

You agree to indemnify, defend, and hold harmless Freedom Protocol, Freedom Protocol Ghana Limited Company, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Platform or Care App
  • Any UGC you submit or post
  • Your violation of this Statement, the Terms of Service, or any applicable law
  • Your reliance on any information obtained through the Platform

9. No Guarantee of Results

Health outcomes vary from person to person. Freedom Protocol makes no guarantees that participation in the community, attendance at events, use of any resources, or consultations through the Care App will lead to any specific health outcome, improvement, or result. Individual results depend on many factors beyond our control, including but not limited to adherence to medical treatment, lifestyle choices, genetics, and the quality of care received from your healthcare providers.

10. Governing Law & Jurisdiction

This Statement shall be governed by and construed in accordance with the laws of the Republic of Ghana, including but not limited to the Ghana Data Protection Act, 2012 (Act 843), the Electronic Transactions Act, 2008 (Act 772), and relevant public health legislation. Any disputes arising from this Statement shall be subject to the exclusive jurisdiction of the courts of the Republic of Ghana.

Where users access the Platform from the European Economic Area (EEA) or United Kingdom, the provisions of the General Data Protection Regulation (EU) 2016/679 shall apply to the extent they afford greater protection.

11. Severability

If any provision of this Statement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect.

12. Changes to This Statement

We reserve the right to update or modify this Statement at any time. Changes will be effective upon posting on this page with an updated “Last Updated” date. Your continued use of the Platform after any changes constitutes acceptance of the revised Statement.
